Terms of Use

Welcome to WickWatch. These Terms of Use ("Terms") govern your access to and use of the WickWatch mobile application ("App") and related services provided by Pete Kraft ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using any part of the WickWatch App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Pete Kraft.

2. Description of Service

WickWatch is a candle safety management application that helps users track burning candles, set timers, receive safety alerts, and organize candles by room. The App is designed as a personal safety tool and is available on iOS and Android platforms.

The App provides the following features:

• Room organization for candle tracking
• Candle management with custom names, scents, and icons
• Burn timers with push notification alerts
• Burn history tracking
• Premium subscription features including unlimited rooms, unlimited candles, email alerts, and SMS alerts

3. Account Registration

To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You may sign in using third-party authentication providers including Apple, Google, and Microsoft. By using these services, you also agree to their respective terms of service.

4. Subscriptions and Payments

WickWatch offers optional premium subscription plans ("Premium") that provide access to additional features. Premium subscriptions are available as:

• Monthly Plan: $4.99 per month
• Yearly Plan: $29.99 per year

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Payment will be charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

You may manage your subscription and turn off auto-renewal by going to your device's account settings after purchase. No refunds will be provided for the unused portion of a subscription term.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to any part of the App or its related systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to transmit any harmful, offensive, or illegal content

6. Safety Disclaimer

WickWatch is a supplementary safety tool and should not be relied upon as the sole means of candle safety. The App provides reminders and tracking features, but it is your responsibility to ensure candle safety in your home. We strongly recommend following all candle manufacturer safety guidelines and never leaving burning candles unattended.

We do not guarantee that the App's notifications or alerts will be delivered in a timely manner or at all, as delivery depends on factors outside our control, including your device settings, network connectivity, and third-party notification services.

7. Intellectual Property

The App, including its design, features, content, and all related intellectual property, is owned by Pete Kraft and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Account Deletion

You may request deletion of your account and associated data at any time through the App's Settings screen. Upon account deletion, your personal data will be permanently removed from our servers in accordance with our Privacy Policy. Active subscriptions should be cancelled through your device's app store settings before deleting your account.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Pete Kraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the App
• Any failure of the App to deliver notifications or alerts
• Any property damage, personal injury, or fire-related incidents
• Any unauthorized access to or use of our servers or any personal information stored therein

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
